Damage Settlement

A damage settlement compensates a landowner for harm to their property caused by construction or operations, such as crop loss, soil disturbance, or surface damage. It is often a one-time or scheduled payment tied to an easement or surface agreement. The payment is commonly calculated per acre of crop, per tree, or by a negotiated lump sum, and the settlement document releases the operator from further claims for that damage. It is separate from the easement payment and addresses harm done during construction or operations.

Example
After laying a gathering line across the Pearson farm, Basin Midstream pays a $9,500 damage settlement for the destroyed wheat crop and rutted topsoil along the route, in addition to the easement payment the Pearsons already received.
